Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") form a legally binding agreement between you and FaceSculpt Technologies ("FaceSculpt," "we," "us," or "our"). By downloading, installing, accessing, or using the FaceSculpt mobile application ("App") or related website (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use FaceSculpt. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Service, you represent and warrant that:

• You meet the minimum age requirement
• You have the legal capacity to enter into a binding contract
• You are not prohibited from using the Service under applicable law
• All information you provide is accurate and complete

3. Your account

To access most features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept responsibility for all activities under your account
• Notify us immediately at support@facesculpt.app of any unauthorized use
• Not share your account credentials with others
• Not create more than one account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of service

FaceSculpt provides AI-powered facial analysis for aesthetic and educational purposes. The Service includes:

• 468-point facial landmark analysis from photos you submit
• Computed scores across five aesthetic categories
• Personalized protocol recommendations
• Weekly progress tracking
• Educational content related to facial aesthetics

The Service is provided "as is" and we may modify, suspend, or discontinue features at any time with reasonable notice.

5. Subscriptions and payments

Subscription tiers

FaceSculpt offers subscription plans (e.g., weekly, annual) with pricing displayed in-app. Pricing varies by region and may change with notice.

Billing

All payments are processed through Apple App Store (iOS) or Google Play (Android). We never see, store, or process your payment card details. Refer to Apple or Google's billing terms for payment processing.

Auto-renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. The renewal charge equals the then-current subscription price unless you cancel.

Free trials

If we offer a free trial, you must cancel before the trial ends to avoid being charged. Unused portions of free trials are forfeited if you subscribe to a paid plan.

Price changes

We may change subscription prices with at least 30 days notice. Continued use after a price change takes effect constitutes acceptance of the new price.

6. Cancellation and refunds

You may cancel your subscription at any time through your device's subscription settings:

• iOS: Settings → [your name] → Subscriptions → FaceSculpt → Cancel
• Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions → FaceSculpt → Cancel

After cancellation, you retain access until the end of the current paid period. We do not provide pro-rated refunds for partial periods.

Refunds: Refund requests are handled by Apple or Google per their respective policies. We cannot directly refund payments processed through these platforms. For Apple: reportaproblem.apple.com. For Google: support.google.com/googleplay.

7. Acceptable use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any law
• Upload photographs of anyone other than yourself, or photographs taken without the subject's consent
• Attempt to reverse engineer, decompile, disassemble, or otherwise discover source code
• Use automated means (bots, scrapers, scripts) to access the Service
• Interfere with or disrupt the Service or servers
• Bypass measures we may use to prevent or restrict access
• Use the Service to develop a competing product
• Impersonate any person or entity
• Harass, threaten, or harm others
• Upload malicious code, viruses, or any harmful content
• Sell, resell, rent, or commercially exploit the Service without our written permission
• Remove or modify any proprietary notices or labels

8. User content and license

You retain ownership of any content you submit to the Service, including facial photographs ("User Content").

By submitting User Content, you grant FaceSculpt a worldwide, non-exclusive, royalty-free, limited license to host, store, process, and display your User Content solely for the purpose of providing the Service to you. This license terminates when you delete the content or your account.

You represent and warrant that:

• You own or have all necessary rights to your User Content
• Your User Content does not violate any third party's rights
• Your User Content complies with these Terms and applicable law

We do not use your User Content for advertising, share it with third parties for their commercial purposes, or sell it.

9. Intellectual property

The Service, including its software, design, content, algorithms, trademarks, and "FaceSculpt" name, is owned by FaceSculpt Technologies and is protected by copyright, trademark, patent, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or create derivative works
• Use our trademarks without written permission
• Frame or mirror any part of the Service
• Use the Service to train AI models or compile databases

10. Medical and health disclaimer

FaceSculpt is NOT a medical device, diagnostic tool, or substitute for professional medical advice.

The Service:

• Provides aesthetic guidance and entertainment only
• Does not diagnose, treat, cure, or prevent any disease or condition
• Has not been evaluated by the U.S. Food and Drug Administration (FDA), European Medicines Agency (EMA), or any equivalent regulatory body
• Should not replace consultation with qualified healthcare professionals (dermatologists, plastic surgeons, dentists, mental health professionals, etc.)

Always consult a qualified healthcare provider before:

• Starting any skincare regimen, especially with active ingredients
• Making decisions about cosmetic procedures
• If you have skin conditions, allergies, or other medical concerns
• If protocol recommendations cause adverse reactions

If you experience any adverse reaction to a recommended product or protocol, discontinue use and seek medical attention immediately.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.

We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure
• The results obtained will be accurate or reliable
• Any errors will be corrected
• The Service will meet your specific requirements

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACESCULPT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Damages resulting from your use of or inability to use the Service
• Damages resulting from any unauthorized access to your data
• Damages from third-party content or services
• Damages arising from health decisions made based on Service recommendations

Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of:

• The amounts paid by you to FaceSculpt in the 12 months preceding the event giving rise to the claim, or
• USD 100

Some jurisdictions do not allow limitations on incidental or consequential damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless FaceSculpt and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use of or access to the Service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights
• Your violation of applicable law

14. Termination

You may terminate your account at any time by deleting it through the Settings menu or emailing support@facesculpt.app.

We may terminate or suspend your access immediately, without prior notice or liability, if you breach these Terms.

Upon termination:

• Your right to use the Service ceases immediately
• You remain liable for all amounts due up to the date of termination
• Provisions that by their nature should survive (intellectual property, disclaimers, liability limits, indemnification) will survive

15. Dispute resolution

Informal resolution

Before filing any formal claim, please contact us at legal@facesculpt.app to attempt informal resolution. We will work with you in good faith to resolve disputes.

Arbitration

If informal resolution fails, you and FaceSculpt agree to resolve disputes through binding individual arbitration, except for: (a) small claims court actions, (b) intellectual property disputes, and (c) injunctive or equitable relief.

Arbitration shall be conducted under the rules of the relevant arbitration body in your jurisdiction. You may opt out of this arbitration provision by emailing legal@facesculpt.app within 30 days of first agreeing to these Terms.

Class action waiver

You agree to resolve disputes only on an individual basis. You waive any right to participate in class, collective, or representative actions, except where prohibited by law.

16. Governing law

These Terms are governed by the laws of India, excluding its conflict of laws principles. For users in the European Union, mandatory consumer protection laws of your country of residence also apply.

17. Changes to terms

We may update these Terms from time to time. Material changes will be communicated by:

• Email at least 30 days before changes take effect
• In-app notification
• Updating the "Last updated" date

Continued use after changes constitutes acceptance. If you disagree, you must stop using the Service.
